Terms of Use

These Terms of Use govern access to and use of Fabricata Track, including its public pages, workspaces, imports, schedules, reports, exports and support.

Introduction

Fabricata Track is provided as a South African software-as-a-service platform for structural steel fabrication project management: tracking production progress by weight, managing project schedules, recording delays, and producing progress and schedule reports.

Acceptance of Terms

By creating an account, uploading data or using any output from Fabricata Track, you agree to these terms and the related policies linked from the legal pages. If you use the service for a company, you confirm that you are authorised to accept these terms for that company.

About Fabricata Track

Fabricata Track calculates progress, stage completion, production rates and forecast dates from the information users enter or import. It is a planning and reporting tool, not a replacement for project management judgement, production supervision, engineering, or quality control.

Eligibility and Account Registration

You must provide accurate account, company and contact information. You are responsible for keeping login credentials confidential and for all activity under your account or workspace.

Customer Workspace and Authorised Users

Workspace administrators control which users may access the workspace and what role each has. The administrator is responsible for assigning appropriate roles, removing users who no longer need access, and ensuring that users comply with these terms.

Accuracy of User Input

Fabricata Track relies on user-entered and imported information. You are responsible for checking assembly and part lists, marks, quantities, weights, workflows, stage credits, planned dates and progress entries before relying on any output.

Progress, Forecasts and Schedules

Progress percentages, earned tonnage, stage progress, production rates, projected completion dates, health indicators and bottleneck indicators are calculations from your data. Forecasts are estimates, not promises. Fabricata Track does not guarantee that any project, activity or delivery will be completed on any date.

Reports Sent to Third Parties

You decide which reports you send to customers, contractors or other parties, and you remain responsible for their content. Review a report before sending it.

Early Access and Pricing

Fabricata Track is in early access. Before any charge applies to your workspace, pricing will be published and you will be asked to agree to it. Nothing is charged without that agreement.

Suspension and Termination

Fabricata Track may suspend or terminate access where an account is misused, compromised, used unlawfully, or reasonably believed to create an operational, security or legal risk.

Prohibited Use

You may not use Fabricata Track to break the law, attack the service, upload harmful files, attempt to access another workspace, reverse engineer the platform, scrape content at scale, or interfere with other users.

Third-Party Services

Fabricata Track uses third-party providers for hosting, databases, file storage and email. Those services may have their own terms and privacy notices.

Intellectual Property and Customer Data

Fabricata Track software, interface, workflows, report templates, branding and documentation are protected intellectual property. Customers retain ownership of their own project data, imported lists, drawings, documents and business information. Fabricata Track receives only the rights needed to provide, secure, support and improve the service.

Privacy

Personal information is handled according to the Privacy Policy / POPIA Privacy Notice. Avoid entering unnecessary personal information into project fields, notes, file names or documents.

Disclaimers

Fabricata Track does not certify engineering, fabrication, scheduling, contractual or compliance decisions. Outputs may be incomplete or incorrect if input data is incomplete, outdated or inconsistent with real workshop conditions.

Limitation of Liability

To the maximum extent allowed by South African law, Fabricata Track will not be liable for indirect, special, consequential, operational, production, delay, penalty, rework, downtime, lost profit, lost revenue or third-party losses arising from use of the service or reliance on its outputs.

Indemnity

You agree to indemnify Fabricata Track against claims, losses, costs or damages arising from your unlawful use of the service, inaccurate data entered by you, unauthorised user activity, misuse of outputs, or breach of these terms.

Changes to the Service and These Terms

Fabricata Track may update, improve, remove or change features as the service develops, with reasonable efforts to avoid unnecessary disruption. These terms may be updated from time to time; the latest version will be posted with a new last-updated date.

Governing Law

These terms are governed by the laws of the Republic of South Africa. South African courts will have jurisdiction unless another lawful dispute process is agreed in writing.
